Include public holidays in actual working time
Access: Admin area > Horaires de travail > Onglet Général > Encart Jours travaillés (plus d'option)
In the “Heures comptées en cas de jours fériés” column, enter the number of hours that must be counted as actual working time in the timesheet.
Generally, this is the number of daily contractual (theoretical) working hours.
If the employee usually works 7 hours that day, enter 7h on the public holiday.
Calculation in the timesheet
In the timesheet/activities, the hours corresponding to the public holiday are counted as worked:
Do not include public holidays in actual working time
Access: Admin area > Horaires de travail > Onglet Général > Encart Jours travaillés (plus d'option)
If you do not wish to include public holidays in actual working time, enter 00:00 in the “Heures comptées en cas de jours fériés” column:
Calculation in the timesheet
In the timesheet, hours will be deducted from the expected theoretical time:
But what does the law say?
Public holidays are not considered actual working time for calculating overtime, according to the Cour de cassation (Cass. soc., April 4, 2012, no. 10-10.701).
On the other hand, the administration takes the opposite position (circulaire DRT no. 2000-07 of December 6, 2000).
